Commercial Terms

1. Seller Information

These Commercial Terms apply to all purchases of digital products and subscription services on FantasyAI ("Service"). The contract is entered into between you as a consumer and:

The Service constitutes a digital service under the rules on digital content and digital services (implemented 1 January 2022 pursuant to EU Directive 2019/770). By completing a purchase you confirm that you have read and accepted these terms.

2. Age Requirement

You must be at least 18 years old to use the Service and make a purchase. By accepting these terms you confirm:

• That you are at least 18 years old
• That you have the legal capacity to enter into a binding agreement
• That the information you provide at registration and purchase is correct and complete

We reserve the right to suspend accounts that cannot verify their age in relation to access to any age-restricted features of the Service.

3. Prices and Payment

• All prices are stated inclusive of any applicable taxes unless otherwise indicated.
• Payment is processed securely via third-party providers (Stripe, Mollie, PayPal, Razorpay, Paddle, LemonSqueezy). We do not store your card details.
• For subscriptions, payment is charged automatically on the renewal date.
• We reserve the right to change prices with 30 days' written notice to existing subscribers. Price changes take effect at the next renewal after the notice period.

4. Subscriptions and Credits

• Credits: Credits are consumed for each image generation and cannot be refunded once used.
• Subscriptions: Subscription plans provide recurring access to credits and features. Subscriptions auto-renew unless cancelled.
• Cancellation: You may cancel your subscription at any time via your account profile under "Subscription" or by contacting us. Cancellation must be made at least 24 hours before the next automatic renewal to avoid a charge for the following period.
• Access after cancellation: You retain access to the Service until the end of the already paid period.
• Unused credits: Unused credits expire on cancellation and cannot be transferred or paid out.

5. Right of Withdrawal (14 days)

As a consumer you have under the Danish Consumer Contracts Act (forbrugeraftaleloven) § 18 the right to withdraw from your purchase within 14 days from the date of the agreement, without giving any reason.

Exercising the right of withdrawal:

Contact us by email at contact@secretfantasyai.com with a clear statement of your decision to withdraw. You may use the standard withdrawal form at retsinformation.dk.

Refund: We will refund your payment without undue delay and no later than 14 days from the day we receive your withdrawal notice (forbrugeraftaleloven § 22).

Exception — digital content and digital services:

Under forbrugeraftaleloven § 18(2)(13), the right of withdrawal lapses for digital content not supplied on a tangible medium if:

• Delivery has begun with your express prior consent, and
• You have acknowledged that the right of withdrawal thereby lapses.

When completing a purchase of credits or a subscription you will be asked to actively confirm this. The right of withdrawal lapses from the moment delivery begins (i.e. from the moment credits are credited to your account or subscription access is activated).

Note: If delivery has not yet begun, the right of withdrawal applies in full for 14 days.

6. Warranty / Reklamationsret

• One-off purchases (credit packages): 2-year warranty from the date of delivery.
• Ongoing subscriptions: The warranty applies for the entire period the subscription is delivered, as this constitutes ongoing delivery of a digital service. You may claim for defects and faults for as long as your subscription is active.
• Presumption rule (12 months): If a defect arises within the first 12 months after delivery, it is presumed to have existed at delivery. The burden of proof lies with us (købeloven § 77a as amended).
• In the event of defects you are entitled to remedy or replacement. If this cannot be done within a reasonable time, you may claim a proportionate price reduction or cancel the purchase and get your money back.

Warranty claims should be made to us as soon as possible and no later than within a reasonable time after you have discovered the defect.

7. Refunds

• Credits already consumed for image generation cannot be refunded.
• Unused credits on voluntary cancellation of a subscription are not refunded unless otherwise required by law.
• In the event of defects or faults for which we are responsible (e.g. technical errors preventing access to the Service), we process refund requests individually in accordance with the warranty (§6).
• Refunds are made to the original payment method within 14 days of approval.

8. Content Restrictions

It is not permitted to use the Service to generate content that:

• Depicts minors sexually or in any explicit manner (CSAM) — this is reported to the authorities
• Violates applicable Danish and international law
• Infringes third-party intellectual property rights (copyright, trademarks, etc.)
• Promotes non-consensual sexual content or deepfakes of real persons — prohibited under the proposed Danish Copyright Act amendment (§§ 65-a and 73-a, expected enacted 2025/2026)
• Contains hate speech, discrimination or incitement to violence
• Is defamatory or harassing

We moderate content and may delete content and terminate accounts in the event of violations. Violations may be reported to the police. See our Terms of Service for the full acceptable-use policy.

9. Intellectual Property

• Your prompts: You retain ownership of the text prompts you provide.
• Generated images: You own the images you generate, subject to the licence terms of the underlying AI models. We make no claim of ownership over your generated content.
• Service IP: All software, technology and algorithms powering the Service belong to CMTStudios and may not be copied, reverse-engineered or distributed.
• AI model licences: Certain generated images may be subject to open-source or Creative Commons licences from the underlying AI models.

You grant us a limited, non-exclusive licence to store and process your generated images solely for the purpose of providing the Service.

10. Privacy and Data Protection

We process your personal data in accordance with GDPR, the Danish Data Protection Act and the EU AI Act. See our Privacy Policy for details on what data we collect, the purposes and your rights.

11. SFW-Only Platform and Content Standards

The Service is exclusively a Safe For Work (SFW) platform. Sexually explicit, NSFW, or adult content is not offered, not available, and not permitted on this platform under any circumstances.

Absolute prohibition — sexual content involving minors (Danish Criminal Code § 235)

• It is strictly prohibited and a criminal offence to generate, possess, store or distribute sexual material involving or depicting persons under 18, cf. Danish Criminal Code § 235.
• This also applies to AI-generated, drawn or manipulated material depicting minors sexually.
• We have zero tolerance for such content. Any suspected violation is immediately reported to the police and to the National Cyber Crime Centre (NC3) and/or the Internet Watch Foundation (IWF).
• Accounts involved in such violations are closed immediately and permanently.

Content moderation and enforcement

• All generated content is subject to automated safety filtering and content moderation in accordance with our Terms of Service.
• Attempts to circumvent content filters or generate prohibited material will result in immediate account termination without refund.
• We cooperate fully with Danish and international law enforcement authorities where required by law.

12. Limitation of Liability

The Service is provided "as is" and "as available". To the extent permitted by Danish consumer law:

• We disclaim liability for indirect loss, including operating loss, lost data or consequential damages
• Our total liability to you is limited to the amount you have paid in the 3 months preceding the damage
• The disclaimer does not apply in cases of gross negligence or wilful misconduct on our part

These limitations do not apply to the extent that Danish consumer law mandatorily prescribes otherwise.

14. Governing Law and Jurisdiction

These terms are subject to Danish law. Any disputes are resolved by the Danish courts unless mandatory consumer rules prescribe otherwise.

If we cannot reach an agreement, you may submit a complaint to Forbrugerklagenævnet (forbrug.dk). EU consumer redress information is available at consumer-redress.ec.europa.eu. The former EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025.

15. Changes to Terms

We reserve the right to amend these terms. Material changes will be notified with at least 30 days' prior written notice by email and/or on the website. Your continued use of the Service after the notice period constitutes acceptance of the updated terms.

16. Miscellaneous

Severability: If a provision is declared invalid, the remaining provisions are not affected.

Entire agreement: These terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and CMTStudios regarding the Service.
