1. Acceptance of Terms

By accessing or using FantasyAI ("Service", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and FantasyAI.

2. Age Requirements and Age Verification

You must be at least 18 years old to use this Service. By using our Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

We reserve the right to request additional age verification and to suspend accounts that cannot verify their age.

3. Account Registration and Security

To use certain features of our Service, you must register an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate and current
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You may not share your account credentials with others. You are responsible for maintaining the confidentiality of your account.

4. AI Generation Service

Our Service uses artificial intelligence to generate images based on text prompts you provide. You acknowledge and agree that:

• Generated images are created by AI systems and may not always produce expected results
• AI-generated content may contain inaccuracies, biases, or unexpected elements
• The quality and accuracy of generated images depend on the prompts and parameters you provide
• We do not guarantee that generated images will meet your specific requirements or expectations
• AI generation involves computational resources and processing time

5. Content Policy and Acceptable Use

You agree not to use our Service to generate or upload content that:

• Depicts minors in sexual contexts or any sexually explicit manner
• Contains child sexual abuse material (CSAM) or any form of child exploitation
• Violates applicable laws or regulations
• Infringes on intellectual property rights, including copyrights, trademarks, or patents
• Promotes or depicts non-consensual sexual content
• Contains hate speech, racism, discrimination, or promotes violence
• Depicts real people's likeness, body, facial features or voice without consent (deepfakes) — prohibited under the proposed Danish Copyright Act amendment (§§ 65-a and 73-a, expected enacted 2025/2026)
• Contains defamatory, libelous, or harassing content
• Promotes illegal activities or provides instructions for illegal acts

We reserve the right to review, moderate, and remove any content that violates this policy. Violations may result in immediate account termination and reporting to law enforcement authorities where required by law.

6. Content Restrictions and Prohibited Material

The Service is intended exclusively for generating SFW (Safe For Work) content. Sexually explicit or NSFW content is not offered and is not permitted on the platform.

Absolute prohibition — sexual content involving minors (Danish Criminal Code § 235)

• It is strictly prohibited and a criminal offence to generate, possess, store or distribute sexual material involving or depicting persons under 18, pursuant to Danish Criminal Code § 235. This also applies to AI-generated and manipulated material.
• We have zero tolerance. Any suspected violation is immediately reported to the police and NC3/IWF. Accounts are closed immediately and permanently.

Persona rights and deepfakes (proposed Danish Copyright Act §§ 65-a and 73-a)

• It is prohibited to generate AI content that imitates a person's likeness, body, facial features or voice without consent. Under the proposed Danish Copyright Act amendment (§§ 65-a and 73-a, expected enacted 2025/2026), affected persons will have the right to issue takedown notices and claim compensation.
• We will remove such content upon takedown request and cooperate fully with affected persons and authorities.

7. Intellectual Property Rights

Intellectual property ownership is as follows:

• Your Content: You retain ownership of text prompts and other content you provide to our Service.
• Generated Images: You own the images you generate, subject to the licenses of the underlying AI models. We claim no ownership of your generated content.
• Service IP: All software, algorithms, interfaces, and technology powering our Service remain our exclusive property.
• AI Model Licenses: Generated images may be subject to the licensing terms of the AI models used (e.g., Creative Commons, open-source licenses).

You grant us a limited, non-exclusive license to store, process, and display your generated images solely for providing the Service and as necessary for technical operations.

7. User Responsibilities and Warranties

You represent and warrant that:

• Your use of our Service complies with all applicable laws and regulations
• You have all necessary rights, permissions, and consents for any content you provide
• You will not use our Service for any unlawful or prohibited purpose
• You will not attempt to circumvent any technical measures or security controls
• You will not use automated tools to abuse our Service or generate excessive requests
• You will not reverse-engineer, decompile, or attempt to extract our AI models or algorithms

8. Privacy and Data Protection

Your use of our Service is governed by our Privacy Policy, which explains what data we collect, the purposes and legal basis for processing (GDPR Art. 6), and your rights as a data subject.

9. Account Suspension and Termination

We reserve the right to suspend or terminate your account and access to our Service at our sole discretion, without prior notice, for any reason including but not limited to:

• Violation of these Terms or our Content Policy
• Suspicious or fraudulent activity
• Abuse of our Service or resources
• Non-payment of fees or charges
• Providing false or inaccurate information
• Violation of applicable laws or regulations

Upon termination, your right to use the Service will immediately cease. We may also delete your account data and content in accordance with our data retention policies and applicable law.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW:

• We make no warranties regarding the accuracy, reliability, or quality of generated images
• We do not guarantee uninterrupted or error-free operation of the Service
• We are not responsible for any loss or damage resulting from your use of the Service
• We are not liable for any content generated by our AI systems

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify, defend, and hold harmless FantasyAI and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms shall be resolved through:

• Good faith negotiations between the parties
• If unresolved, through the courts of Denmark

Notwithstanding the foregoing, you may also have the right to lodge a complaint with your local data protection authority regarding privacy matters.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and/or sending you an email notification. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on our Service, constitute the entire agreement between you and FantasyAI regarding the use of the Service.
